Andy "Big Red" Reid.  Andy, Andy, Andy...how many times have those words left your mouth, usually in a rapidly rising voice, followed by nervous pacing or objects being thrown? 

He is the head coach and vice president of the team.  As if he's so skilled at the one job that he needs the challenge of the other.  10, 11, 12 years and counting of the same nonsense.  Promoting incompetent people like Sean "McDoormat" McDermott.  Making no discernible in-game adjustments.  Using the same tired schemes over and over.  Passing the ball 70% of the time has never won a SB, but don't bother telling Andy that. 

Quite possibly the most stubborn person you'll ever observe in your life.  Refuses to run the ball, even when you have guys like Brian Westbrook and LeSean McCoy in the backfield.  Even when you are lining up James Thrash and Todd Pinkston as your wideouts.  He undervalues play-making positions like D-line and LB, instead preferring to fill them with seventh round Draft picks and cast-offs from other team's practice squads.  Andy will gladly trade you his first round pick today for two fifth round picks three years from now.  Nothing changes with this guy.  Nothing.  Never has and never will.

The Florida Gators (7-5 overall and 4-4 in SEC play) actually were awarded a bowl bid with a hefty financial payout ($3,100,000) based on past performance.


No other explanation of why Florida is in the Outback Bowl really makes any sense.


Florida will be playing in Tampa against Penn State while South Carolina will face Florida State in the Chick-fil-A Bowl (awarded to the SEC’s No. 5 finisher) and Mississippi State  (who beat Florida straight up and finished a game ahead overall) will play Michigan in the Gator Bowl (meant for the SEC’s No. 6 team).


Who cares that Florida was “less than Florida” this year.  We all know they’ll rebound, and it just seems more like a big game with them than without them.

Being smart online consumers doesn’t mean being cheap



If there is one constant in our online world it is the whining and moaning from old media, and to a growing extent new media, about how they are losing money because consumers don’t want to pay the same price for electronic versions of goods as they do for the actual in-hand physical version.


In fact there is a post currently on Fast Company titled Internet Users Still Cheap, Spend Only $1 to $10 on Digital Content, and while it might be a great pageview grabbing headline I find it rather insulting. In the post Austin Carr writes:


The digital marketplace is the likely savior of most industries. That is, if consumers are willing to spend money on the web. Do we expect too much for free online?


Sorry but it’s not just a matter of wanting everything for free, even though that is still a driving factor, but rather, I believe, that the consumer understands a very fundamental difference between online electronic versions of physical goods and the goods themselves – it’s availability.


You see when you walk into a store to buy a product you can see that there are only so many of copies of the item that is available. Whether it be a movie DVD, a game, a book or any item that is inherently available in electronic form, the price of a physical version is based on the cost of actually manufacturing those physical copies and making them available.


Yet when you go to buy that online in its pure electronic form those incurred costs change, and change radically. The consumer almost instinctively gets this and that is something that content producers continually try to ignore. The reality is that online electronic goods shouldn’t cost the same, or in some cases more than their brick and mortar equivalents.


Online consumers aren’t cheap. If they were businesses like Amazon or even the many t-shirt businesses would be able to stay in business. The consumer is smart enough to know that a physical product, whether it be a t-shirt, or a book, or even a physical copy of a movie or music album, has a cost to produce and are more than willing to pay those prices.


So when a consumer turns around and says that they don’t want to pay physical goods prices for the electronic versions they aren’t being cheap and to suggest otherwise is insulting their intelligence. They are however more than willing to pay what they consider to be a fair price as long as you make it easy for them.











According to the affidavit, the investigation included the co-operation of authorities in Canada, France and Germany.



As for code, the LOIC DDoS software believed to be used by Operation Anonymous remain available on the social code site Github and on SourceForge. Thousands of people have downloaded it from those sites. The software allegedly makes it easy for a user to donate their computer's bandwidth to repeatedly messaging a target server until it is rendered inaccessible by other users.



The ephemeral group Anonymous, or Operation Payback, co-ordinated a series of such attacks earlier this month against Paypal, Mastercard, Visa and others. These global leaders in money transfer were criticized for preventing their customers from donating money to the controversial website Wikileaks, despite the site having been convicted of no crimes.



Clearly a sufficient number of people in the FBI believe the denial of service attacks may constitute felony-level damage to computer systems, but others have argued that the campaign falls broadly within the tradition of non-violent civil disobedience and political protest.



FBI Agent Allyn Lynd, whom The Smoking Gun reports signed the affidavit, has been in the technology news media before. He lead a 2009 raid on at least two Texas web hosts over an alleged federal crime concerning unpaid bills to AT&T and Verizon. Those raids disrupted a number of co-located but unrelated businesses, including some that allege the disruption cost them millions of dollars.



In this latest affidavit, Lynd argued again that he may need to disrupt some other servers temporarily in order to achieve his goal of determining which servers were relevant to his investigation. Due to the document's incomplete publication, whether any sense of irony was appreciated is unclear.



No information has been made available to date regarding any FBI or other law enforcement investigation of the denial of service and other technical attacks made against the Wikileaks website.

Making Money Now


The new Republican majority in the House of Representatives has begun the process of repealing the Healthcare law. Some have argued that, because the Senate may not repeal it as well, and the President will likely veto it, the House’s repeal is purely “symbolic.”



Just as the reading of the Constitution on the floor of the House, on Wednesday, was symbolic of a “return to constitutionalism,” as Charles Krauthammer writes, the repeal of the Healthcare law in the House will be symbolic not just of the fact that Republicans have heard the will of the American people, but also that they fully understand that the new law is, only superficially, a jumbled and thoughtless mess of rules about how healthcare should be delivered and paid for in this country. In reality, the Healthcare law is a liberal power grab that is gradually permitting the federal government to control more of our lives, making more people dependent upon the government and continuing the culture of dependency among minority groups who, up until now, have mostly voted liberals into power. The symbolism of the repeal will ring loud and clear.


Liberal Democrats will be launching a big campaign over the next few days, doing what they always accuse Republicans and conservatives of doing- “fear-mongering.”  They will be telling their constituents that, according to the Congressional Budget Office, the repeal of the Healthcare law will increase debt, that Republicans don’t want people with pre-existing conditions to have access to health insurance, and that Republicans want to defund Medicare, new chairman of the House Budget Committee, Congressman Paul Ryan, has set out why these claims are wrong.


However, one of the features of the new Healthcare law, already in effect, is the extension of healthcare coverage to adult children (up until 26 years old), a hallmark of the true intention of this law- to make more people dependent, while it raises premiums on private health insurers who need more money to meet this new requirement.



For those who do not have adult children in the 21 to 26 age range, would it surprise you to know that these adult “children,” who are now covered, are not required to even live with their parents to remain on their plans, and that they may even be married and still be covered under their parents’ health plans?


Through the new Healthcare law, liberal Democrats have gradually introduced the concept that adult children should remain dependent on their parents, and when their parents are not around, perhaps the government can take over in that parental role? Of course, this new rule comes at a time when the economic decline made it difficult for young adults to obtain jobs. This is how the gradual creep of dependency begins: introduce a law which creates dependency on the government at a time of crisis, so that uninformed Americans will see it as a caring and positive intervention to help them in their time of need. This is how every entitlement legislation begins, and why none has ever been totally eradicated thus far, mainly because people have come to expect these benefits.


One of the newly elected members of Congress who understands well the liberals’ drive to make more Americans dependent on the government is Colonel Allen West of Florida. Congressman West will be serving in the Congressional Black Caucus and hopes to represent conservative philosophical ideas such as the importance of individual responsibility, creativity, and entrepreneurship.






In addition, as a result of the left’s encouragement of this culture of dependency, those who are truly in need will no longer have to seek voluntary assistance from neighbors and communities. Conversely, neighbors and communities will not be encouraged to voluntarily reach out to others because the knowledge that the government will provide for their friends’ needs may cause them to think twice. As such, dependency on the government creates more distance, and less connectivity, among members of a community.


At this point in time, any resistance to repealing the Healthcare law, and replacing it with commonsense legislation that reflects free market principles, will be almost entirely about continuing the culture of dependency, a hallmark of liberalism, that has taken over this country. We can be sure that liberals from the previous Congress will try hard to keep this culture in place. Their ability to remain powerful depends on it.




Not really. TD has always said that piracy is against the law. What Mike and others often aregue, is that the laws should be changed in favour of the consumers, not faceless megacorps.



I think you're right in that TD often encourages more sane laws in favor of the public vs corporations, but as far as piracy goes, my take on the TD line is that legality is a non-issue now that technology makes it hard NOT to copy something, what's important is finding a way to make money in spite of it. Pragmatism is the name of the game.



Now the *comments* on TD run all over the map. There's a lot of soft endorsement of illegal distribution, along with people who are outright loud about it. There are people who seem to think that artists are lazy chumps who want a free ride, and people who apparently have a problem with anyone exercising any legal muscle. Luckily there are some dissenting voices of reason, who are neither "IP Maximalists" nor "Freetards". (All these phrases and sloganeering are dumb as hell and only serve to trivialize how complicated these issues really are. "Pooperty" anyone? Let's cut out this ad campaign for issues and appeal to people through their reason and intellect)



I do kind of wish they would bring in some writers with more varied opinions. For instance, I agree with the criticism that TD loves to dispense business advice for musicians without any real clear idea of what goes into a musical career. The complicated web of credits and legalities that go into bringing multiple creative people together with their own input to and ownership of a project (We're not all solo artists!), the insane logistics of performing on a consistent basis and taking it on the road, the idea that fans just buy the hell out of merch, the notion that the internet has made distribution *easier* (it's not, it's *cheaper*, but only to get started), and the idea that grass roots projects can "bubble up" to the surface without a professional PR push and management team (Amanda Palmer works with a publicist and several managers, besides the fact she's "married" to Neil Gaiman, one of the most popular writers of the last 20 years. She's not a model for future musicians). But the reality is that even a no name blogger is pitched music by major labels every day, so not having a professional management/publicist team to pitch you, more importantly to give you legitimacy, means your emails most likely will never be opened.



Now, it is true that some artists will in fact bubble up, but it's mostly going to be boring mid-level talent with an interesting story behind them. Meh. I'd trade a thousand Susan Boyles/Ted Williams/Homeless Flavor of the Month for just one Jim Croce or Leonard Cohen.

Obviously for REO there will be two peaks. The first was in late 2008 and largely private-label securities and subprime, and the 2nd will probably be in 2011 and be heavily GSE REOs.



The height of the 2nd peak depends on the number of foreclosures, and the how quickly the lenders can sell the REOs. The foreclosure-gate related moratoriums have slowed the foreclosure process, but foreclosures will probably pick up again in early 2011. My guess is the 2nd peak will happen in 2011 and be close to the same height as in 2008.



One of the key issues is the number of delinquent loans (and loans in the foreclosure process). I use the Mortgage Bankers Association (MBA) quarterly data and LPS Applied Analytics monthly data to track delinquencies.

This graph based on the MBA quarterly data shows the percent of loans delinquent by days past due. The MBA reported that 13.52 percent of mortgage loans were either one payment delinquent or in the foreclosure process in Q3 2010 (seasonally adjusted). This was down from 14.42 percent in Q2 2010.



Most of the decline in the overall delinquency rate was in the seriously delinquent categories (90+ days or in foreclosure process). Part of the reason is lenders were being more aggressive in foreclosing in Q3 (before the foreclosure pause) - hence the surge in REO inventory in the first graphs! Some of the decline was probably related to modifications too.



This graph provided by LPS Applied Analytics shows the percent delinquent, percent in foreclosure, and total non-current mortgages through November.



The percent in the foreclosure process is trending up because of the foreclosure moratoriums.



According to LPS, 9.02% of mortgages are delinquent (down from 9.29% in October), and another 4.08% are in the foreclosure process (up from 3.92% in October) for a total of 13.10%.



With falling house prices, the delinquency rate could start rising again since more homeowners will have negative equity. However just because a homeowner has negative equity doesn't mean they will default. It usually takes another factor such as loss of employment, divorce, or a medical emergency for the homeowner to default.



On the other hand, an improving labor market will help push down the delinquency rate. My guess is the overall delinquency rate has peaked, although I expect the delinquency rate to stay elevated for some time.

CNN: Ford, Chrysler recalling thousands of vehicles

Ford Motor Co. is recalling 19,600 2011 model year trucks and crossover SUVs over concerns that an electrical short could cause a fire, the manufacturer said Thursday. Chrysler Group LLC also is recalling nearly 145,000 trucks and crossover wagons in three separate campaigns for steering, stalling and airbag concerns, according to letters posted this week on the website of the National Highway Traffic Safety Administration.


CNNMoney: Jobless claims drop below 400,000 mark

For the first time in more than two years, the number of Americans filing for their first week of unemployment benefits fell below 400,000 last week - a ray of hope in the one of the longest job droughts in U.S. history. The number of initial claims fell to 388,000 in the week ended Dec. 25, down 34,000 from the week before, the Labor Department said Thursday.


Fortune: Goldman bonus pool looking shallower

The days of the $500,000 average paycheck are long gone, even at Wall Street's most gilded firm. So predicts a report issued Thursday by Credit Suisse analyst Howard Chen. He slashed his fourth-quarter earnings estimate on Goldman Sachs (GS) to $3.70 a share from $5.08, citing its latest soft trading quarter and higher non-compensation expenses.

With Sunday night's announcement that Goldman Sachs had invested $450 million in Facebook, one could almost hear the supple leather stampede of Ferragamo loafers beating down Lloyd Blankfein's door. After all, with Goldman's rare "special purpose vehicle," its private clients would be able to invest $1.5 billion collectively, without the SEC's oversight, in a social network that Goldman conveniently just inferred was worth $50 billion. And all for the rumored low, low cost of a minimum of $2 million and a promise not to sell until 2013. That is, if clients were willing to do it within the week and without the requisite memorandum explaining the risks.



Such is the magic of Goldman, reasons Fortune contributing editor Duff McDonald. In an article about the five reasons McDonald is not buying Facebook stock — including the troubling facts that (1) no one knows the company's actual financials, and (2) people use it to play backward games like Farmville and Cityville — he also cited Goldman's involvement as a reason to be wary. But we prefer to see McDonald's criticism as yet another reason for Goldman to be proud of being so dang vampire squid about the whole thing. Market manipulation is so baller. We're glad it's making a comeback so early in the new year.



Reuters' Felix Salmon has already pointed out that Goldman's motivation in investing in Facebook is partly to lock down the lead slot as a book runner for when the company does go public. Others have remarked that, depending on the fees that come with Facebook going public, Goldman might pay for its investment on that alone. According to Yipit founder Vinicius Vacanti, when you count them up, Goldman's strategic investments in Facebook actually value the social network closer to $36 billion. McDonald pegs it at $39 billion. Although, of course, it's in Goldman's interest to make everyone think Facebook looks like it's worth $50 billion, which might explain the rush job and lack of private placement memo.



By McDonald's hypothetical math, if Facebook offered the public a chance to buy 20 percent of the company in an IPO, that would be worth $10 billion. Goldman would earn a 2 percent underwriting fee as a book runner on that $10 billion, picking up $200 million. McDonald continues:



Goldman would have to share such spoils, so let's call it $100 million into their pocket. Subtracting that underwriting fee [$100 million] from the Goldman investment [$450 million], and you could easily make the case that for a net purchase price of $350 million, Goldman's ante only values Facebook at $39 billion. Hey, that's just off by $11 billion, so don't worry about it. Buy your shares where you can get them. In other words, go open a $10 million minimum private client account at Goldman Sachs. (Who says Goldman didn't learn its lesson about shafting its own customers? This time around, they've managed to get the customers to line up the shaft themselves.)



C'mon, you don't get to be America's great big bubble machine by expending energy trying to shaft clients. You gotta teach them to do it for themselves. Sorta like "give a man a fish," only, you know, with shafting. By Salmon's reasoning, even if Facebook stays private, Goldman could make out with an even handsomer reward with more private placement deals. "Right now, [Goldman's] in the highly enviable position of having the exclusive ability to parcel out Facebook shares to its own clients, and to make money on pretty much every trade in Facebook shares. That, surely, is more valuable than any one-off IPO fee." The greatest trick the devil ever played was convincing the world that Facebook was definitely worth $50 billion in January 2011? Is Lloyd Blankfein Keyser Söze?
